Template — Legal Review Required

This document is a drafted template provided for convenience. It has not been reviewed by a qualified lawyer. Before relying on it, have it reviewed and customised by a legal professional qualified in your jurisdiction (Northern Territory, Australia). ParamedicPlus and its operators accept no responsibility for the adequacy of this template for your specific circumstances.

1. Acceptance of Terms

By accessing or using ParamedicPlus ("the Platform", "we", "us", or "our"), you agree to be bound by these Terms of Use and Privacy Policy. If you do not agree, do not use the Platform. These terms apply to all users, including students, instructors, and administrators.

2. Training Simulation — Not Medical Advice

The Platform is a clinical training simulation only. It is not a medical device, does not provide medical advice, and does not constitute a substitute for professional clinical judgement, formal paramedic education, or the official St John Ambulance Australia (NT) Inc. Clinical Practice Manual (CPM).

  • Simulated patient responses, vital signs, and clinical outcomes are generated by artificial intelligence and may not reflect real-world physiology or presentations.
  • AI-generated patient and scene images are synthetic and do not depict real patients or real clinical findings.
  • Scores, feedback, and debriefing content are approximate educational aids and may contain errors.
  • Never use the Platform's outputs to guide real patient care or clinical decision-making.
  • Always refer to the current official St John NT CPM and your service's clinical guidelines for real practice.

3. AI-Generated Content — Accuracy Limitations

The Platform uses artificial intelligence to generate and evaluate clinical content, including patient responses, performance scores, feedback, and references to clinical protocols. AI-generated content:

  • May contain factual errors, including incorrect protocol citations, drug doses, or clinical reasoning.
  • May not reflect the most recent updates to the St John NT CPM or other clinical guidelines.
  • Should not be relied upon as a sole source of clinical information.
  • Must be independently verified against authoritative, current clinical sources before any educational or professional use.

We do not warrant that AI-generated content is accurate, complete, or current. You assume full responsibility for verifying all clinical information obtained through the Platform.

4. Clinical Reference Content

The Platform provides summaries of clinical protocols, drug information, ECG rhythm descriptions, and educational media (including images sourced from third-party providers). This content:

  • Is a study aid only and may be incomplete, simplified, or out of date.
  • May not reflect the latest version of the St John NT CPM or other referenced guidelines.
  • Does not cover all clinical presentations, contraindications, or edge cases.
  • Third-party media is used under educational or fair-use provisions and is credited where applicable; it may not represent all presentations of a given condition.

Always confirm clinical information against the official, current source documents before applying it in any context.

5. No Certification or Competency Guarantee

Completion of simulations, achievement of scores, or earning of badges on the Platform does not certify clinical competence, confer any formal qualification, or satisfy any regulatory or registration requirement. The Platform is an educational tool and does not replace formal education, clinical placement, or assessment by a recognised training authority. Instructors are responsible for their own assessment decisions when using Platform analytics or rubrics.

6. Subscriptions, Free Trial & Payments

The Platform offers paid subscription plans (Student and Instructor) billed monthly via Stripe. A 7-day free trial may be available to eligible new users.

  • Free trial: If you start a free trial, you receive full access for 7 days. The trial expires automatically after 7 days unless you purchase a subscription.
  • Billing: Paid subscriptions are billed in advance on a monthly basis through Stripe, our payment processor.
  • Auto-renewal: Subscriptions auto-renew each month until cancelled. You can cancel at any time; access continues until the end of the current billing period.
  • Refunds: We do not offer refunds for partial billing periods. Contact us if you believe you have been charged in error.
  • Price changes: We may change subscription fees with reasonable notice. Existing subscribers will be notified before any change takes effect.

7. User Accounts & Conduct

You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account. You agree to:

  • Provide accurate registration information.
  • Use the Platform only for lawful educational purposes.
  • Not attempt to access another user's data or circumvent access controls.
  • Not use the Platform to make real-world clinical decisions or provide medical advice to others.

8. Privacy & Data Handling

We collect and process personal data necessary to provide the Platform, including:

  • Account data: email address, name, and role (student/instructor/admin).
  • Usage data: simulation sessions, scores, actions taken, and performance analytics.
  • Subscription data: subscription status and tier, processed via Stripe. We do not store your full card details — Stripe handles payment securely.

We use this data to provide and improve the Platform, generate analytics, and manage subscriptions. We do not sell your personal data. Instructors and admins may view data relevant to their students or groups. You may request access to or deletion of your personal data by contacting us. See the Contact page for details.

9. Intellectual Property

The Platform, its software, design, and original content are owned by ParamedicPlus. Clinical protocol content references the St John Ambulance Australia (NT) Inc. CPM, which remains the property of its respective owners. Third-party media is credited to its sources and used under educational or fair-use provisions. You may not copy, redistribute, or republish Platform content without permission, except for personal educational use.

10. Limitation of Liability

To the maximum extent permitted by law:

  • The Platform is provided "as is" and "as available" without warranties of any kind, express or implied.
  • We do not warrant that the Platform will be uninterrupted, error-free, or that clinical content is accurate or current.
  • We are not liable for any direct, indirect, incidental, or consequential damages arising from your use of, or reliance on, the Platform or its content.
  • You use the Platform at your own risk. Any reliance on AI-generated or reference content is solely at your discretion and responsibility.

11. Indemnity

You agree to indemnify and hold harmless ParamedicPlus, its operators, and affiliates from any claims, damages, or losses arising from your misuse of the Platform or your reliance on its content in real-world clinical contexts.

12. Changes to These Terms

We may update these Terms from time to time. Material changes will be notified through the Platform or by email. Continued use after changes take effect constitutes acceptance of the revised Terms.

13. Governing Law

These Terms are governed by the laws of the Northern Territory, Australia. Any disputes arising in connection with these Terms or the Platform are subject to the exclusive jurisdiction of the courts of the Northern Territory.

14. Contact

For questions about these Terms, privacy, or the Platform generally, please use the Contact page.
